The polling was presented to Starmer at some point between June or July 2019, providing Starmer with an in-depth scan of the Labour memberhip’s views and opinions. The meeting at which McSweeney gave Starmer this briefing is also relayed as the moment at which McSweeney and Starmer began actively collaborating towards Starmer’s election as Labour leader.

18. Additional evidence of arguably unprofessional conduct towards female staff was found in the language used to attack Karie Murphy, which was particularly loaded. Oldknow frequently called her Medusa, another staffer claimed her ‘face would make a good dartboard,’ while Heneghan called her a ‘bitch-face cow.’ In one exchange about women working in LOTO, Oldknow commented of Murphy that ‘Karie is actually fat too. There’s a good old [roll] in that photo.’ When Tracey Allen piped in to say that Oldknow didn’t hate Murphy because she was fat, but because Murphy was ‘horrible,’ a short tongue-in-cheek discussion included comments of how some ‘chubby’ people were still likeable. Oldknow, conceding the point, still concluded, ‘And she is fat.’ Another staffer joined the conversation to add, ‘As the Smiths said some girls are bigger than other girls. Except Katy and Kary who are just hideous and sour.’

19. In March 2017, for example, in response to news that three senior LOTO staffers had left, Heneghan commented that ‘Steve needs to be next out’. On April 22, 2017, in the immediate aftermath of May’s announcement, Heneghan asked whether there was a way to block Howell from joining group calls. In response to the group call that then took place, Emily Oldknow wrote of Howell: ‘he is ridiculous’. At the end of April, participants in the Senior Management Team WhatsApp group responded angrily to an email sent by Howell raising issues with how staff at Southside were behaving. ‘Twat’, was Heneghan’s response. Five days later, during another campaign meeting, Heneghan and Tracy Allen, McNicol’s assistant, provided the SMT group with live running commentary. ‘Fuck you Steve’, Heneghan wrote. ‘He is appalling’, Allen commented. And after a strategy meeting in May, McNicol piped up on SMT to comment that ‘Steve was shit’, with which Oldknow agreed: ‘Absolutely shit’.

20. The spreadsheet set out allocations of funding by seat. The spreadsheet set out how each seat would receive three categories of funding: a baseline amount of £2,000 for staffing, which was then boosted at the discretion of the party machinery (this total was simply called ‘Round 1’, but constituted a short-term allocation that had to be spent by candidates on election collateral by May 3); an amount set aside to pay for a ‘self-mailer’ (a pamphlet campaign sent by post) paid from the party’s central election funds; and an allocation of funds to be used on Promote, the party’s internal software used to purchase and place social media advertising.

21. A majority of candidates (but by no means all) listed on the spreadsheet received at least a small amount of core ‘Round 1’ funding. But only seventeen MPs received funding allocations for the mailer paid by HQ or the discretionary social media spending.

22. The seventeen MPs who received the ‘self-mailer’ or Promote allocations (or both) were: Gloria De Piero (married to a senior figure in Tom Watson’s office, and revealed by the leaked WhatsApp chats to be a favourite of HQ), Margaret Beckett, Jonathan Ashworth (the husband of Emily Oldknow and now the head of Labour Together), Heidi Alexander, Chuka Umunna, Angela Eagle, Liam Byrne, Shabana Mahmood (later to play a role in Labour Together), Tom Watson, Khalid Mahmood, Emma Reynolds, Pat McFadden, Rosie Winterton, Rachel Reeves (another Labour Together MP), Yvette Cooper, and Keir Starmer.

23. In early April 2017, the party’s polling and analysis team put together a list of all seats held by the Labour Party and shared this data with Patrick Heneghan. The analysis assigned every seat held by the party a code ranging from D1 to D5. ‘D’ meant ‘defensive’. Seats classified D5 were the least threatened, while those classified D1 were the most threatened. Starmer’s constituency of Holborn and St Pancras was classified D5. In fact, none of the seventeen seats awarded the two categories of discretionary funding were classified D1 or D2.

The amounts allocated to these seventeen figures were extraordinary in the context of the party’s straitened finances. In total, the spreadsheet set out expenditure of £1,739,000, which covered the entire party. Of this, £316,000 was allocated to just these seventeen MPs. So, 18 percent of the Labour Party’s entire allocation at this stage was set aside for just 7 percent of its MPs. Even as Starmer’s Holborn and St Pancras seat was safe, classified D5 and predicted to achieve a 9 percent majority according to polling from mid-April, his constituency was allocated £10,000 to pay for his election mailer and a further £3,000 to spend on Promote. Jeremy Corbyn, by comparison, received literally nothing at all—not even a baseline allocation—even though his seat, also a D5, was predicted to have a smaller margin of victory than Starmer: only 1 percent.

24. Heneghan claims the instructions were delivered by Karie Murphy in a meeting on May 19, 2017. According to Heneghan, Murphy provided him during that meeting with a ‘hitlist’ of individuals that LOTO wanted funding removed from, as well as a list of left-wing MPs she wanted the party to fund. Murphy threatened Heneghan, he claimed, with a hit-piece on the website Skwawkbox if he declined to follow her instructions. Murphy has denied the allegations that she instructed or threatened Heneghan.

Heneghan further claims that Corbyn’s team was unwilling to face the realities of dire polling. Their approach to campaigning would lead the party to ruin, he argued, pointing his finger at Steve Howell. In a response that Heneghan would later write to the party trying to avoid suspension, he was explicit that ‘we agreed that we could not simply pull support away from seats based on Karie’s factional view. We agreed to continue to support seats on the basis of getting the most possible MPs elected. In order to do this, we had to move a number of staff and resources to Ergon House’.

29. On May 29, while Howell was being denied additional funds, a Labour staffer emailed Patrick Heneghan, Simon Mills, and Andrew Coulson. Mills, as noted, was the most senior financial executive in the party; Coulson was his junior. The staffer informed ‘Simon/Andrew’ that the budget code being used by Matthews (GEL001) needed a budget increase to £175,000. Coulson responded shortly thereafter confirming ‘budget increased to £175,000’. Matthews was thus being allocated additional funds just as Howell was being told only £50,000 was available. The staffer forwarded the email confirming the budget increase to Sam Matthews and other staffers, including the party’s head of print services, Gillian Barry. ‘See below from Andrew Coulson increasing the budget to £175k ‘, he wrote. Even with this increase, staff fretted that Matthews would need more money.

30. On the afternoon of the 29th, Geldard emailed Heneghan, Mills, Matthews, and two other staffers asking for a budget catch-up the following day ‘as we think we will need to move more money into GEL001’. The following day, Harry Gregson wrote to Mills, Heneghan, Coulson, and Geldard with the subject line ‘staffing budget to GEL001’. Suggestions were made as to how unspent money from other budgets could be moved into GEL001. ‘I think that will give Sam what he needs’, Geldard commented, confirming that it was explicitly known that the budget increases to the GEL001 code were to facilitate Matthews’ printing plan. Mills approved the request: ‘Ok, we will amend’, Mills commented.

31. A spreadsheet distributed by Coulson to Mills on June 12 showed that a total of £225,852 had been allocated to GEL001, against which a total of £135,014 had been committed or spent. Not all of this £135,014 would have been spent on Ergon House, as it appears that the budget code became something of a catch-all for a range of expenses in the earliest phases of the campaign.

32. Geldard sent an email to Sam Matthews with a ‘priority list’ for ‘DCHAIRS’. This was likely a reference to Deck Chairs, itself a reference to how staffers jokingly called the Ergon House scheme the ‘Deck Chair Realignment Society.’ This was a play on ‘shuffling the deck chairs on the Titanic’.

33. The ten constituencies (and their MPs) on the DCHAIRS list were Ashfield (Gloria de Piero), Don Valley (Caroline Flint), Wolverhampton North East (Emma Reynolds), Normanton, Pontefract and Castleford (Yvette Cooper), Wakefield (Mary Creagh),Bradford South (Judith Cummins), Derby South (Margaret Beckett), Stoke-on-Trent North (Ruth Smeeth), Penistone and Stocksbridge (Angela Smith)

35. As noted above, the total amount allocated to the budget code GEL001 was £225,852, of which £135,014 was spent. Some of this was spent on materials seemingly unrelated to Ergon House. However, internal budget documents show that, under the GEL001 code, certain spending was recorded with the descriptor ‘Sam Matthews Key Seats Printing’. The internal budget documents show 35 entries under this descriptor, with all invoices being raised by Potts Print, which provided printing services to the Labour Party. In total, £47,209.19 was recorded against these entries (inclusive of VAT).

36. I was able to establish this in the following way. First, I consulted the party’s internal accounting spreadsheets, including a sheet distributed in August 2017 and then again in November 2017. These workbooks set out the details of spending by the party’s HQ during the general election. This included spending entered against the GEL001 spending code. Second, I identified every amount spent against the descriptor ‘Sam Matthews Key Seats Printing’ as this was clearest evidence of spending incurred by the Ergon House scheme. Every entry under this descriptor referred to an invoice raised where spending was incurred. Every spending item, according to the worksheet, paid for services provided by Potts Print. Potts Print is a printing house used frequently by the party. Third, I then searched through the Electoral Commission’s Party spending register for every invoice submitted as Labour Party spending for invoices raised by Potts Print. In doing so, I identified an invoice dated June 7, 2017 from Potts Print. The invoice amount was for £7,359.99. This matched, exactly, an entry under the ‘Sam Matthews Key Seats Printing’ for the same amount. 37. I suspect that Ruth Smeeth was the ultimate beneficiary of this amount because the spending, here, referred to Individual Electors Letters, and Geldard’s May 30 email had identified Smeeth (in Stoke-on-Trent North) as a priority ‘DCHAIRS’ recipient for precisely this sort of material. Geldard’s DCHAIRS list did not identify any other MPs or constituencies in Stoke to receive Individual Electors Letters in this email.

38. I established this by asking for the spending returns for the seven constituencies, which was duly provided to me by the Electoral Commission under a Freedom of Information request.

39. This was also the description used in the invoice raised by Potts Print

40. There are two circumstantial pieces of evidence that raise suspicions that these were the sort of materials that should have been declared locally. First, at the very time that Sam Matthews was sending out the GOTV materials, he received text of a flyer to be printed for Yvette Cooper. These were then sent by Matthews to Potts Print with a subject line referring to Individual Electors Letters. Emails show the flyer text had been written by Yvette Cooper herself. The text makes it clear that this was a letter being written directly from Yvette Cooper to her constituents explaining why she, personally, deserved their votes—the essence of local spending. However, Yvette Cooper was not on the £7,359 Potts Print invoice, so I don’t know if this flyer was ultimately printed, and, if so, how it might have been paid for. But there is no doubt that it was sent to Potts at the same time as the other GOTV materials, with a subject line referencing the Individual Electors Material, and in the same packaged format as other ‘Individual Electors Letters’ that did appear on the Potts Print invoice. Second, social media searches also uncovered pictures of a mailed flyer sent on behalf of Mary Creagh. The flyer text shows it was printed by Potts Print, while the social media posts indicate it was delivered by post shortly after May 30. The flyer features a smiling Creagh on her constituency letterhead. The text urged people to vote for her notwithstanding any qualms they might have had about Labour’s national leadership: ‘That’s why, whatever your misgivings about the Labour leadership, I hope that you will consider voting for me as your local MP. I am independent minded and put Wakefield first’.

8. My use of these messages will no doubt lead to a chorus of complaints about privacy. But this is misplaced. These were not messages sent between users private accounts. Instead, they were messages sent via Skype for Business, which was integrated into the Party’s Microsoft Outlook professional package. The messages were exchanged in a discreet window in Microsoft Outlook. This is material because the Skype accounts employees were using were registered against the Labour Party email addresses, while the messages were sent via the Outlook interface set up by the Party for its staff to conduct its business. The messages were thus akin to work emails, as they were sent directly between Party staff and saved on the Party servers against their email addresses.

13. The ambiguous phrasing of the EHRC’s report make this a difficult knot to untie. But there is at least inferential evidence that the EHRC was, in fact, referring to the June 2019 refusals. In particular, at page 68 of the report, the EHRC stated, in relation to the WhatsApp messages revealed in the Leaked report, that ‘the Labour Party did not volunteer these messages (such as WhatsApp messages and personal emails) when we requested relevant personal communications regarding antisemitism complaints. The Labour Party informed us that it would be disproportionate and too onerous to provide this material to us. However, as indicated above, it appears that a vast amount of this material was collated for the preparation of the Labour Party’s own leaked report’. Of course, as noted in the body text, the EHRC had never requested the personal communications of the staff members included in the SMT and LP Forward Planning Groups by name.

21. The EHRC cited, in its discussion of agents and the availability of a ‘reasonable steps’ defence, two pieces of precedent. Strikingly, one of those cases cited noted the anomalous situation wherein a ‘reasonable steps’ defence was available to employers in relation to employees but not available to so-called ‘principals’ with regards to their agents. The EHRC appears not to acknowledge that the precedent it cited already raised questions about this unexplained distinction between employers and principals and the availability of the defence.
